Activities participation statement
It is the responsibility of the individual to inform the Club or Society Committee, Club Captain, Coach, Trip Organiser or Activity Leader of any relevant medical condition or previous injuries the Aberdeen University Students' Association (AUSA) should be aware of which may affect your or others safe participation in the activities of the Club or Society.
By becoming a member of a Club or Society you agree to adhere to and abide by the guidelines for participation as laid out by the Club or Society as well as those laid out by the AUSA.
You may be participating in activities that may involve an above average element of risk, in an environment where professional medical care and rescue services may not always be immediately available. In view of this it is your responsibility to ensure that you fully understand the exact nature of each activity you undertake, the risks involved and the equipment needed for your safe participation.
You should never participate in an activity where you are unsure of any of the above aspects. If in doubt, ask any of your Club or Society Committee members or the AUSA Sports or Societies Administrator for further information. It is also your responsibility to notify your next of kin of your desire to participate, before engaging in that activity.

Terms & Conditions of Membership of the Sports Union and Societies Union at
Aberdeen University Students’ Association 2013 – 2014
In these Terms:
AUSA means the Aberdeen University Students’ Association, Butchart Centre, University Road, Aberdeen, AB24 3UT; Included within AUSA are the Sports Union and Societies Union;
Member means the person named on/ associated with relevant Individual Membership;
Contract means the contract between the Member and AUSA relating to the Member’s use of the Services;
Membership Sign-Up means the AUSA Membership webpage(s) to which these terms are appended;
Membership Fee means the relevant membership fees advertised in all AUSA published literature and on the AUSA website relating to the Service from time to time;
Rules means the rules and policies which apply to accessing and participating in the activities of AUSA and its constituent Sports Clubs and Societies;
Services means the involvement by the member in the activities and services facilitated by AUSA and its constituent Sports Clubs and Societies and supported by the University;
University means The University of Aberdeen, King's College,Aberdeen, AB24 3FX;
The headings in these terms are for convenience only and shall not affect their interpretation.
2. Supply of the Service
2.1 AUSA and its constituent Sports Clubs and Societies shall provide the activities and services to the Member subject to these Terms.
2.2 AUSA may correct any typographical or other errors or omissions in any brochure, promotional literature, quotation or other document relating to the provision of the Services without any liability to the Member.
2.3 AUSA may at any time without notifying the Member make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Services, or which in the opinion of AUSA are reasonably necessary to protect the interests of AUSA.
2.4 The Member shall comply with the Rules.
3.1 The Member shall pay the appropriate Sports or Societies Union Membership Fee from time to time for the provision of the Services when the Membership Sign-Up is completed and submitted to AUSA. The Member shall in addition pay from time to time such charges and penalties as specified by AUSA where/ when necessary.
3.2 All fees quoted to the Member for the provision of the Services are inclusive of any value added tax.
4. Warranties & Liability
4.1 AUSA warrants to the Member that the Services will be provided using reasonable care and skill whilst acknowledging and discharging its Duty of Care.
4.2 AUSA shall not be liable to the Member or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of AUSA’s obligations in relation to the Services, if the delay or failure was due to any cause beyond AUSA’s reasonable control.
4.3 The Member shall provide all information which is requested by AUSA; without prejudice to clause 4.4 and to the other rights and liabilities of the Member and of AUSA. AUSA shall not be liable for any loss or damage suffered by the Member which is caused or contributed to by the failure to provide any such information.
4.4 Nothing in these terms and conditions is intended to exclude the liability of the AUSA for death or personal injury caused by AUSA’s negligence.
5. Termination and Refunds
5.1 The Contract shall come into force on the date upon which the Membership Sign-Up, completed by the Member, is submitted to AUSA. Subject to the following provisions of this clause, the Contract shall continue until the expiry of the membership category as stated when the membership is purchased.
5.2 If the Member is an officer or employee of, or student enrolled on a course of study at, the University, the Member may terminate the Contract if he ceases to be such an officer, employee or student. The Member may terminate the contract if he suffers an injury or other medical condition, which substantially affects his ability to use the Services. To terminate the Contract in accordance with this clause 5.2, the Member must give to AUSA notice in writing of such termination, as set out in clause 6.2.
5.3. If the Contract comes into force otherwise than by the Member in person attending at the University with the completed and submitted Membership form, the Member shall have the right to terminate the Contract during the period of fourteen (14) days following the date on which the Contract was formed. To terminate the Contract in accordance with this clause 5.3, the Member must give to AUSA notice in writing of such termination, as set out in clause 6.2.
5.4 Membership Fee refunds will be dealt with on a case-by-case basis between AUSA and the Member. The eligibility period for such refunds is fourteen (14) days from the commencement date of the Contract. Refund applications should be directed to AUSA by email (firstname.lastname@example.org) or a written letter to the address given in clause 1.
5.5 AUSA may terminate the Contract forthwith if the Member does not comply with the Rules.
5.6 Refunds will be issued subject to the conditions in stated in clauses 5.1, 5.2, 5.3, 5.4 and 5.5.
6.1 These Terms (together with the terms, if any, set out in the Membership Sign-Up) constitute the entire agreement between the parties, supersede any previous agreement or understanding and may not be varied except in writing between the parties.
6.2 A notice required or permitted to be given in writing under these Terms shall be addressed to AUSA at the address given in clause 1 of these terms and to the Member at the address given on the Membership Sign-Up or at such other address as may at the relevant time have been notified by the Member to AUSA, and shall be delivered by hand or sent by pre-paid first class post, facsimile or electronic mail.
6.3 No failure or delay by either party in exercising any of its rights under the Contract shall be deemed to be a waiver of that right, and no waiver by either party of any breach of the Contract by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.
6.4 If any provision of these Terms is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provision in question shall not be affected.
6.5 Scottish law shall apply to the Contract, and the parties agree to submit to the nonexclusive jurisdiction of the Scottish courts.
6.6 AUSA reserves the right to amend and change these Terms & Conditions, as it deems necessary in the best interests of AUSA and the Member.
In purchasing a membership the Member is aware it is their responsibility to;
Inform the Sports Club and/or Society’s committee/coach/trip organiser of any medical conditions or previous injuries that may affect my safe participation in the sport.
Ensure that they fully understand the exact nature of each activity they will be undertaking, including the risks involved, skill levels required and the equipment needed for their safe participation.
Not participate in any activity where they are unsure of any of the aspects mentioned in point 2.
Notify their next of kin of their desire to take part in the sport before engaging in the activity.
By purchasing membership to AUSA Sports or Societies Union and subsequently joining at least one of its constituent Sports Clubs or Societies, the Member agrees to read the relevant Sports Club or Society’s Code of Practice and to act in accordance with this, the Sports Club or Society’s Constitution and the following AUSA Policies (available online at www.ausa.org.uk):

They also agree that any photographs / videos taken in relation to organised Sports or Societies Union activities may be used by Aberdeen University Students’ Association and/or the University of Aberdeen for promotional/ marketing purposes at their discretion.
Student Cards should be carried at all Sports Clubs or Societies events, and individuals should be aware of their Student ID (matriculation) number.

FW2013 Wristband – Terms and Conditions
i. The official green Freshers' Week 2013 Wristband entitles the wearer to free entry to all official late night events during Freshers’ Week 2013 at The Institute or The Garage/Campus only. Any other events not held at these venues will be ticketed events and not part of the wristband deal.
ii. The wristband entitles the wearer to queue-jump and priority entry at all official late night events at The Institute or The Garage/Campus only for Freshers' Week 2013.
iii. The wristband entitles the wearer to free use of the late night transport service, operated on behalf of AUSA from the official late night venue to university halls of residence.
2. Conditions of purchase and use:
ii. The official green Freshers' Week 2013 Wristband will be sold at a non-negotiable price of £35.00 (inc VAT) per wristband, to be paid by cash (or, where facilities are available, debit or credit card) at designated sites or from the AUSA Online shop at www.ausa.org.uk/freshers/wristband
iii. All partner venues reserve the right to refuse entry due to inappropriate behaviour, apparent excessive alcohol intake, failure to meet minimum age restrictions of 18 or over, failure to produce proof of age, or any other reason as deemed appropriate.
iv. AUSA takes no responsibility for the sale of wristbands to individuals who fail to meet minimum venue entry age restrictions. AUSA will not be held responsible, nor offer any refund, to wearers refused entry to venues if this individual fails to meet a given venue’s admission requirements.
v. All partner venues reserve the right to remove wearers from the venue at the discretion of management, security staff or AUSA staff present within the venue.
vi. This wristband does not guarantee entry into official events due to venue capacity safety restrictions but will facilitate priority entry for the wearer.
vii. The official late night Freshers' Week 2013 venues are The Institute and The Garage/Campus (Aberdeen venues only)
viii. AUSA and official host venues reserve the right to alter, reschedule or cancel entertainment at events without notice and without refund to wristband holders.
ix. AUSA is in no way responsible for wristband wearers taking advantage of the late night transport service from the official late night venue to halls of residence. It is entirely the wearer’s responsibility to ensure they queue appropriately to access the buses provided and behave in a safe and responsible manner for the duration of the journey.
x. The wristband does not entitle the wearer to priority access to transport buses.
xi. Wristbands are intended for use by University of Aberdeen students and are not valid when worn by any other person. AUSA representatives reserve the right to refuse sale of a wristband to a person they suspect of not being a University of Aberdeen student. AUSA and venue representatives reserve the right to refuse wristband benefits if worn by anyone other than a student studying at the University of Aberdeen in 2013/14 and are entitled to request to see appropriate identification, both at the point of sale and throughout Freshers’ Week 2013.
xii. Only one wristband may be purchased per person. Only one wristband may be sold per transaction or at the discretion of the AUSA representative conducting the sale.
xiv. Persons without wristbands, accompanying a wristband wearer, will not automatically be entitled to wristband benefits, including priority entry.
xv. AUSA reserves the right to withdraw the wristband without refund in the event of inappropriate usage by the bearer.
xvi. The wristband must be properly worn on the wrist of the bearer and in good, legible condition in order to be valid. AUSA and official venue representatives reserve the right to refuse benefits if they suspect misuse, including but not limited to transfer of wristbands between individuals.
xvii. Wristbands must be secured in place on the wrist of the intended wearer at the time of purchase, to the satisfaction of an AUSA representative present at the point of sale.
xviii. Wristbands are non-transferable and will not be replaced by AUSA in the event of damage, theft or any other reason.
3. Complaints procedure
1. AUSA will not be held responsible for any failure by partner venues to provide official green Freshers' Week 2013 Wristband entitlements.
2. Any complaints may be lodged with AUSA. Any dispute will only involve partner venues at the discretion of AUSA. Complaints should be made in writing via to firstname.lastname@example.org or by post to AUSA, Butchart Centre, University Road, Aberdeen, AB24 3UT
For the purposes of this contract, Freshers’ Week 2013 begins at 8am Saturday 21st September 2013, and finishes at the closing time of the late night venues on the morning of Sunday 29th September, 2013.‘AUSA’ refers to the Aberdeen University Students’ Association.
